Letter sent on April 2012 To All Home Owners

Re: Infractions against CC&Rs, Rules and Regulations and By-Laws

At the last annual VAW homeowners meeting, a video and commentary were presented with regard to use of the Common Elements of our community.

The Board of Directors was hopeful that residents would "self-police" their use, and abuse, of the common elements within our Village. I’m happy to say many homeowners have made changes in response to this request. However, numerous infractions remain.

The Board had designated a "joint committee" of the building and grounds committees this past winter to review and make recommendations to the Board for action.

The Committee and the Board agree it is necessary to enforce the CC&R’s, Rules and Regulations and By-Laws absolutely as presently written and approved. Every homeowner has received a copy of the CC&Rs, along with the Rules and Regulations and By-Laws. (Copies of these documents are available in the Village Office.) Please review them. It is also important that owners ensure persons who may be renting their unit are aware of their responsibility to comply with the CC&Rs, Rules and Regulations and By-Laws.

An educational and community effort will be implemented in the fall to encourage homeowner compliance. It is important that all homeowners/renters request approval through the office and obtain Board approval before making changes and/or additions to Common Areas. This includes the exterior walls and area immediately surrounding your home.

While it is the intention of the Board of Directors to ensure "reasonable and unrestricted" accommodation to all owners and their tenants, it is necessary that the provisions of the CC&Rs, Rules and Regulations and By-Laws be adhered to and it is each owner’s responsibility to ensure they comply with these provisions to the benefit of all owners.

As part of our Community effort to ensure compliance, anyone in non-compliance will be promptly notified and will have five (5) days to take corrective action. Non-compliance is unacceptable! The Board prefers to not fine anyone, but if necessary, will impose fines as authorized by the Rules and Regulations against individuals not complying.

If you have any questions regarding interpretation of the By-Laws and/or Rules, contact Jim McCann or any Board Member for clarification.

This action is intended to get everyone in the community in compliance with our Association CC&Rs, Rules and Regulations and By-Laws. We all want to keep our community appearance orderly and inviting and more importantly, safe and free from hindrances for emergency personnel. We hope everyone understands the value of these rules and willingly complies with them.

Respectfully,
Marian Grider
President
